1. Who we are
This Privacy Policy describes how AI Plays Games ("we," "us," or "our") collects, uses, shares, and protects information when you visit aiplaysgames.com, use our prompt checkout at aiplaysgames.com/mc, aiplaysgames.com/chess, and related URLs, watch our streams, or otherwise interact with our sites and services (collectively, the "Services").
We operate live and on-demand game streams where viewers can pay to submit prompts that may be shown, read aloud, or acted on during a broadcast. We do not offer user accounts or a traditional login system.

We do not store your full payment card number. Card data is handled by Stripe under its own privacy policy.
We do not operate a signup form that collects email for general accounts. If you contact us through a mailto link (for example, "Join us" on the homepage), we receive only what you choose to put in that message.

We do not use advertising trackers or third-party ad networks on our sites as of the effective date above.

3. How we use information
We use information to:
- Provide the Services — process payments, deliver prompts to our stream pipeline, operate polls and site features, and run live/VOD broadcasts.
- Show content publicly — donor display names, prompt text, and related media may appear on live streams, recordings (VOD), clips, highlights, and social posts. By submitting a prompt, you understand it may be visible to the public.
- Operate and secure the Services — monitor performance, prevent fraud and abuse, enforce our rules, and protect our systems.
- Communicate with you — respond to support requests, payment issues, or emails you send us.
- Comply with law — meet legal, tax, and accounting obligations.
- Improve the Services — understand how features are used and fix bugs.
AI and model providers. To operate streams and process prompts, we use third-party AI and speech APIs (which may include Anthropic, OpenAI, and Moonshot). Prompt text and related context may be sent to these providers on our systems to generate in-stream behavior or audio. Each provider's own terms and privacy policy apply to its processing.
We do not use your prompt content to train public-facing AI models unless we separately tell you and obtain any consent required by law.
4. Legal bases and U.S. framing
Our primary audience is in the United States. U.S. privacy law generally relies on notice (this Policy) and choice where required.
- For most processing, we rely on providing the Services you request, our legitimate interests (security, operations, improvement), and compliance with law.
- Where consent is required, we will ask through a banner, settings, or a clear in-flow choice.
- Paid prompts: by completing checkout, you direct us to process your payment and prompt content to fulfill your purchase, subject to our Terms of Purchase.
5. How we share information
We do not sell your personal information for money.
We share information only as follows:
- Service providers — Stripe (payments), Vercel (hosting, serverless functions, storage), GIPHY (GIF search), ElevenLabs (TTS), and AI model API providers (operator-side stream automation). These providers process data on our behalf subject to their policies and our agreements.
- Public display — prompts and display names may be shared publicly on streams and related media.
- Legal and safety — when we believe disclosure is necessary to comply with law, enforce our terms, protect rights, or protect safety.
- Business transfers — in connection with a merger, acquisition, or asset sale, subject to notice where required.
6. Retention

7. Security
We use reasonable administrative, technical, and organizational measures designed to protect information — for example, payment processing through Stripe (we do not store full card numbers), HTTPS, access controls on operator systems, and hosting with reputable providers.
No method of transmission or storage is 100% secure.
8. Children's privacy (under 13)
Our Services are not directed to children under 13, and children under 13 may not submit paid prompts. If we learn we have collected personal information from a child under 13 in violation of this Policy, we will take steps to delete it.

9. Your California privacy rights (CPRA summary)
If you are a California resident, you may have rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act, including:

- Opt out of sale/share — opt out of "sale" or "sharing" for cross-context behavioral advertising
Our position: We do not sell personal information. We do not share personal information for cross-context behavioral advertising as defined under California law.

Non-discrimination: We will not discriminate against you for exercising CPRA rights.
10. Other U.S. state privacy rights

11. Cookies and similar technologies
See our Cookie & Similar Technologies Notice. You can control cookies through browser settings; clearing site data removes most localStorage entries we use.
12. International users
We are based in the United States. If you access the Services from outside the U.S., your information may be processed in the U.S. and other countries where our providers operate.
13. Third-party links and embeds
Our sites may link to or embed content from third parties (for example, Kick, Twitch, GIPHY, Stripe checkout). Those third parties may collect information under their own policies.
14. Changes to this Policy
We may update this Privacy Policy from time to time. We will post the new version with a revised "Last updated" date. If changes are material, we may provide additional notice. Your continued use after the effective date means you accept the updated Policy, to the extent allowed by law.
